1. Acceptance of these terms

These Terms of Service (“Terms”) are a binding agreement between you and Antilayers Pvt. Ltd. (“thrdwheel”, “we”, “us”), governing your access to and use of the thrdwheel web app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Important: thrdwheel is not a medical or mental-health service

thrdwheel is a wellbeing companion for everyday relationship care. It is not a licensed therapist, counsellor, psychologist, physician, or emergency service, and it does not provide medical, psychological, legal, or professional advice, diagnosis, or treatment.

Using the Service does not create a therapist–client, doctor–patient, or other professional relationship. The AI is an automated system and may produce inaccurate or inappropriate responses. Never rely on it for decisions about your health, safety, or wellbeing.

If you or your partner are experiencing a crisis — including thoughts of self-harm or suicide, abuse, or any emergency — stop and contact your local emergency services or a crisis helpline immediately. thrdwheel cannot help in an emergency and is not a substitute for professional care.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a contract. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

4. The Service

thrdwheel lets two partners each hold private conversations with a shared AI companion. Partners connect by generating and entering a one-time pairing code. The AI builds a private understanding of each person to personalize its responses, and can use only the information you choose to make “shareable” to help your partner (e.g. gift ideas). We may add, change, or remove features at any time.

5. Your account

  • You are responsible for your account and for keeping your password secure.
  • You are responsible for all activity under your account.
  • Provide accurate information and keep it up to date.
  • Notify us promptly at hello@thrdwheel.app of any unauthorized use.
  • One account per person; do not share accounts or impersonate others.

6. Couples and pairing

  • Pairing links your account with your partner’s so you can share one AI companion.
  • Your conversations remain private to you; your partner cannot read them. Only facts you mark shareable can influence your partner’s experience (see our Privacy Policy, §4).
  • Either partner may end the pairing (“breakup / unpair”) at any time. Ending a pairing dissolves the shared link; each person’s own account and data remain separate.
  • You are responsible for whom you pair with. Only pair with a partner who consents.

7. Acceptable use

You agree not to:

  • use the Service for anything unlawful, harmful, abusive, harassing, or that violates another person’s rights;
  • upload or share content that is illegal, hateful, or exploitative, or that you do not have the right to share;
  • use the Service to make decisions requiring professional (medical, legal, financial) advice;
  • attempt to reverse-engineer, scrape, overload, disrupt, or gain unauthorized access to the Service or its systems;
  • misuse the AI to generate harmful, deceptive, or illegal content, or to circumvent safety measures;
  • use the Service on behalf of anyone who has not consented, or to surveil or coerce another person.

We may suspend or terminate accounts that violate these rules.

8. AI-generated content

Responses are generated by an automated AI model. They may be inaccurate, incomplete, outdated, or inappropriate, and do not represent our views or professional advice. You are solely responsible for how you interpret and act on them. Do not treat AI output as a substitute for a qualified professional. We do not guarantee any particular outcome from using the Service.

9. Your content

You retain ownership of the content you submit (“Your Content”). To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content, and to create derived data (such as memory), solely to provide, secure, personalize, and improve the Service for you, and to route it to our processors (including the AI provider) as described in our Privacy Policy. You represent that you have the rights to submit Your Content and that it does not violate these Terms or any law.

10. Subscriptions, trials, and payments

  • Some features may be offered free; others may require a paid subscription. One subscription covers both partners in a couple.
  • Prices, plans, and any free trial are shown on our pricing page and may change; changes won’t affect the period you’ve already paid for.
  • Paid subscriptions renew automatically for the same period unless cancelled before renewal. You can cancel at any time; access continues until the end of the current period.
  • Refund terms: [state your refund policy — e.g. no refunds except where required by law, or a defined refund window].
  • Taxes may apply. Payments are processed by a third-party payment provider subject to its terms.

11. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by Antilayers Pvt. Ltd. or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by law.

12. Third-party services

The Service relies on third-party providers (including our AI, hosting, and payment providers). We are not responsible for third-party services, and your use of them may be subject to their own terms. See our Privacy Policy for who we work with.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTILAYERS PVT. LTD. AND ITS OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR RELATIONSHIPS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON AI OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) [e.g. INR 5,000]. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Antilayers Pvt. Ltd. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. content licence for already-processed data, disclaimers, liability limits, indemnity, governing law) will survive.

17. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to applicable law, the courts at [City], India will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue. Nothing here limits any mandatory consumer rights you may have in your country of residence.

18. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service.
